CyberUp Academy Conditions of Participation
1. Registration, ordering & billing
Registration is binding as soon as a confirmation has been sent by CyberUp. As places are limited, places will be allocated in the order in which registrations are received.
The prices stated in the submitted offer or on the website are exclusive of statutory VAT. They are due for payment upon receipt of the invoice, without deductions and stating the invoice number. Before the start of the course, we will send you the invoice to the e-mail address you provided in the registration form. Unless otherwise stated in the order confirmation, the participation fee refers to one person and one event date and includes digital course materials as well as lunch and drinks during breaks in the case of on-site courses. Travel costs for trainers for in-house training courses are not included in the price and will be charged separately (separate offers will be made for this anyway).
2. Course execution
CyberUp reserves the right to cancel an event if the minimum number of participants is not reached – you will be informed at least 5 working days in advance. CyberUp is also entitled to make changes to trainers, venues, dates and the course of the program if necessary. Participants will be informed of such changes in good time. If a course does not take place, the participation fee already paid will be refunded in full and without deductions. Further claims of the client are excluded, including the case that a participant misses a seminar day through his own fault.
The participants themselves are responsible for hotel reservations and the costs of accommodation and meals outside the seminar times.
The course times given, including duration and end times, are for guidance only and may vary due to interactions or discussions with participants. Our trainers always strive to provide participants with the best possible learning experience. However, there is no guarantee that the specified times will be adhered to exactly. A certificate of attendance will be issued if at least 80% of the teaching units have been successfully attended.
3. Refusals, cancellations, changes
Cancellations must be made in writing and are free of charge up to 10 working days before the start of the event at the latest. The withdrawal deadline is only deemed to have been met if the written declaration of withdrawal is received at the e-mail address provided for this purpose within this period. Cancellations made at shorter notice, but at least 2 working days before the event, will incur a fee of 30% of the participation fee. In the event of non-participation or cancellation after the first day of the event, the full participation fee will be charged. The cancellation fee is due immediately upon receipt of the notice of withdrawal and must be paid regardless of the reasons for withdrawal. The cancellation fee is clearly waived if the customer provides a substitute participant who fulfills the participation requirements and pays the participation fee.
If the customer wishes to rebook to an alternative date, this must be done by e-mail. CyberUp will check on a case-by-case basis whether a rebooking is possible and under what conditions. However, there is no legal entitlement to rebooking.
4. Copyright
All course content and materials are the copyright of CyberUp GmbH. The term “material” includes all printed materials as well as digital media, virtual machines or digital assets provided by CyberUp and intended for use in courses. These materials are intended exclusively for the personal use of the participants. It is prohibited to present, copy, reproduce, distribute or create derivative works, with or without modification, of course materials without express written permission. Commercial use of the materials is also prohibited without the prior written consent of CyberUp.
5. Liability
CyberUp is only liable for damages that can be proven to be due to intentional or grossly negligent behavior within the scope of the contractual relationship or that can be classified as typical and foreseeable damages. In the event of force majeure, which leads to a delay in the start of the course or a complete cancellation, no liability is assumed. CyberUp also assumes no responsibility for damages that may arise due to incomplete or incorrect information in the course materials. During an on-site course, CyberUp is not liable for theft or loss of items brought by the client.
